These terms govern your use of the Helixtop service (“the Service”), operated from Thrissur, Kerala, India. By subscribing you agree to them.
Helixtop provides hosted business management software on a subscription basis. Each customer receives a private workspace containing their own data, isolated from every other customer.
You are responsible for keeping your login details confidential and for all activity under your account. Tell us promptly if you believe an account has been compromised. You must provide accurate business information, including a valid GSTIN where you are registered for GST.
If payment fails or an invoice is not settled, we may suspend access to your workspace. Suspension does not delete your data. Access is restored once payment is received. If an account remains unpaid for 60 days we may terminate it and delete the data after giving you notice and a reasonable opportunity to export it.
Your business data belongs to you. We claim no ownership of it. You may request a complete export at any time and we will provide it in a standard format. We do not sell your data or use it to train anything.
We aim to keep the Service available at all times but do not guarantee uninterrupted operation. Planned maintenance will be notified in advance where practical.
You may not use the Service to break the law, to send unsolicited bulk email, to store material you have no right to store, or to attempt to gain access to another customer’s workspace.
The Service is built on open-source software licensed under the LGPL and AGPL, together with our own additions. Where AGPL-licensed components are used, the corresponding source is available on request.
To the extent permitted by law, our total liability in connection with the Service is limited to the fees you paid in the three months before the claim arose. We are not liable for indirect or consequential loss, including loss of profit or data, save where such exclusion is not permitted by law.
You may cancel at any time; cancellation takes effect at the end of your current paid period. We may terminate for material breach of these terms after notice.
These terms are governed by the laws of India. The courts at Thrissur, Kerala shall have jurisdiction.
